Privacy Policy

Sphena (“Sphena”, “we”, “us”, or “our”) is provided by Sphena Team. This Privacy Policy explains how we collect, use, disclose, and protect information when you use the Sphena mobile application (the “App”), related services, and our support channels (collectively, the “Services”).

If you do not agree with this Privacy Policy, please do not use the Services.

Age Requirement (17+)

The Services are intended for users aged 17 and above. We do not knowingly collect personal information from anyone under 17. If you believe a minor has provided personal information to us, please contact us so we can delete it.

What Sphena Does

Sphena helps you protect your images and showcase your brand by adding custom watermark text to photos. You can:

  • Upload any image and personalize it with your own watermark text to maintain copyright integrity.
  • Choose from a variety of font styles and adjust watermark position and size.
  • Preview different layout effects.
  • Keep a history of edits for revisiting and tweaking.

Information We Collect

We collect information in three ways: (A) information you provide, (B) information collected automatically, and (C) information you allow us to access (with your permission).

Information You Provide

  • Account: name, username, email address.
  • Customer support: messages, attachments, and any information you include in support requests.

Photos / Media Content

  • The App processes photos you select and watermark text you input to generate watermarked images.
  • No facial recognition and no biometric identification.
  • By default, photos and results are stored locally on your device unless you choose a feature that requires server-side processing or storage (for example, backup/sync if available).
  • If any photo/text is uploaded to our servers for a requested operation, it is processed only to complete that operation and is deleted promptly afterward.
  • Not used for advertising/marketing and not used to train machine learning models.

Information Collected Automatically

  • Device information: device model, OS version, language, time zone, and identifiers needed to operate the Services.
  • Usage and diagnostics: feature usage, interaction events, performance metrics.
  • Crash logs: error and crash information for debugging and stability improvements.

Location (Optional)

If you allow location access, we may collect precise or approximate location depending on your settings. You can disable location access at any time in your device settings.

Cookies (If You Use Our Web Properties)

We may use cookies and similar technologies (which may include web beacons) for authentication/login and remembering preferences. You can control cookies through your browser settings.

How We Use Information

  • Provide and maintain the Services.
  • Personalize your experience (e.g., saving preferences).
  • Improve the Services (analytics, troubleshooting, bug fixes).
  • Security and fraud prevention.
  • Customer support and communications.
  • Comply with legal obligations and enforce our rights.

We do not sell your personal information.

Sharing and Disclosure

We share information only as needed and in the minimum amount necessary:

  • With your consent: when you direct us to share.
  • Service providers: trusted processors that help operate the Services under our instructions.
  • Legal/safety: to comply with law or protect rights, safety, and security.
  • Business transfers: as part of a merger, acquisition, or asset sale, with safeguards.

No third-party marketing: We do not share personal information with third parties for their own direct marketing purposes.

International Transfers

Your information may be transferred to and processed in countries other than your own. Where required, we use safeguards such as Standard Contractual Clauses (SCCs) or equivalent measures.

Security

  • Encryption in transit and, where appropriate, at rest.
  • Access controls and least-privilege practices.
  • Regular security reviews/audits and monitoring.
  • Backups and recovery procedures.

No system is 100% secure; you use the Services at your own risk.

Data Retention

  • Account information: retained while your account is active.
  • Account deletion: deletion/anonymization within 30 days after a verified request, unless legally required to retain longer.
  • Usage/analytics: up to 12 months (typically aggregated or de-identified where feasible).
  • Support records: up to 6 months after resolution.
  • Photos/results: local by default. If server-side processing is used, uploaded content is deleted promptly after processing.

Your Rights

Depending on your location, you may have rights to access, correct, delete, restrict processing, and withdraw consent.

Changes

We may update this Privacy Policy from time to time by updating the Effective Date and providing notice as required by law.

Disputes; Governing Law

Governing law will be the laws of the jurisdiction of Sphena Team’s principal place of business. Disputes will be resolved by binding arbitration in English by a single arbitrator under the rules of a recognized arbitration institution, except where prohibited by law. To the extent permitted by law, you and Sphena Team waive the right to a jury trial and to participate in class actions.
